Following the arrest, a police-recorded statement of Toshio Tsumuraya was prepared. The statement principally concerned personal background matters, including his family, education, employment history, property, and drinking habits, and did not contain a detailed account of how the driving began, the route allegedly travelled, or the events leading to the accident.

圓谷年雄の警察官面前供述調書が作成される。同調書には、飲食店で飲酒した後から事故現場で警察官に起こされるまでの記憶がないこと、午後7時50分頃という事故時刻及び事故場所については、警察官から聞いて分かったことが記載される。
A police-recorded statement of Toshio Tsumuraya was prepared. It records that he had no memory from the period after drinking at the restaurant until he was awakened by a police officer at the accident scene, and that he learned the alleged time of approximately 7:50 p.m. and the location of the accident from the police officer.

圓谷年雄が、福島県警察須賀川警察署から福島地方検察庁郡山支部の検察官へ送致される。検察官送致は、逮捕された被疑者の身柄及び事件を警察から検察官へ引き継ぐ手続上の段階であり、有罪立証に必要な証拠が完成したことを意味するものではない。本件では、勾留請求を経て、起訴前の身柄拘束が継続する。
Toshio Tsumuraya was referred by the Sukagawa Police Station to a prosecutor at the Koriyama Branch of the Fukushima District Public Prosecutors Office. Referral to a prosecutor is a procedural transfer of the arrested suspect and the case from the police to the prosecution; it does not mean that the evidence required to establish guilt has been completed. Following a request for detention, his custody continued before indictment.

A police-recorded statement of Toshio Tsumuraya was prepared. Although he stated that he did not remember his conduct after leaving the restaurant or the actual route travelled, the commencement and purpose of the driving and the alleged route were explained through inferences such as “I think” and “I believe,” based on mobile telephone records, the location of the vehicle, his usual route home, and the route normally used by the driving service.

圓谷年雄の立会いにより、市役所駐車場から事故現場までの実況見分が行われ、実況見分調書が作成される。圓谷年雄は、運転を開始した場所及び実際の走行経路を覚えていないと説明したが、市役所駐車場を出発地点、事故現場を到着地点として、「現時点で通るとする道路」が記録され、両地点間の距離が約11.5キロメートルと測定される。
An on-site inspection was conducted in the presence of Toshio Tsumuraya, and an on-site inspection report concerning the route from the city hall parking lot to the accident scene was prepared. Although he stated that he did not remember where he began driving or the actual route travelled, roads that could currently be taken between the city hall parking lot and the accident scene were recorded, and the distance was measured at approximately 11.5 kilometres.

圓谷年雄の警察官面前供述調書が2通作成される。第1通では、前日に作成された実況見分調書添付の運転経路見取図が示され、約11.5キロメートルという距離について警察官から説明を受けたことが記載される。実際の走行経路を思い出したとの記載はなく、事故時刻はこの段階でも午後7時50分頃とされている。第2通では、飲酒した酒類及び飲酒量に関する訂正及び補充が行われる。
Two police-recorded statements of Toshio Tsumuraya were prepared. In the first, he was shown the route map attached to the on-site inspection report prepared the previous day and was informed by the police that the distance was approximately 11.5 kilometres. The statement does not record that he recovered his memory of the actual route, and the alleged time remained approximately 7:50 p.m. The second statement contained corrections and supplementary details concerning the type and amount of alcohol consumed.

The Sukagawa City Council unanimously adopted the first recommendation for resignation against Toshio Tsumuraya while he remained in detention before indictment. At that time, no criminal trial had begun, and the alleged time of approximately 7:40 p.m., later adopted in the indictment and judgment, had not yet appeared in his statements.

当初の勾留期間の満了を前に、刑事訴訟法第208条第2項に基づき、圓谷年雄について勾留期間の延長が認められる。これにより、第1回辞職勧告決議が可決された後も、起訴前の身柄拘束及び取調べが継続する。
Before the expiration of the initial detention period, an extension of detention was granted for Toshio Tsumuraya under Article 208, paragraph 2 of the Code of Criminal Procedure. His pre-indictment custody and questioning therefore continued after the first recommendation for resignation had been adopted.

圓谷年雄の検察官面前供述調書が作成される。同調書では、午後7時9分及び午後7時14分の運転代行業者への発信、午後7時30分の同業者からの着信、午後7時30分頃とされた第三者による走行目撃情報並びに各地点間の推定所要時間を組み合わせ、事故時刻が午後7時40分頃と整理される。この時刻は本人が事故時刻を思い出したものではなく、逮捕後に示された捜査情報及び推定所要時間から逆算されたものであり、それまでの午後7時50分頃から午後7時40分頃へ変更される。
A prosecutor-recorded statement of Toshio Tsumuraya was prepared. The alleged time of the accident was calculated as approximately 7:40 p.m. by combining calls to the driving service at 7:09 p.m. and 7:14 p.m., an incoming call from the service at 7:30 p.m., third-party information that the vehicle had been seen travelling at approximately 7:30 p.m., and estimated travel times between the relevant locations. The time was not based on a recovered memory of the accident but was calculated backwards from investigative information and estimated travel times supplied after the arrest, changing the alleged time from approximately 7:50 p.m. to approximately 7:40 p.m.

Judge Shuichi Nezaki of the Koriyama Branch of the Fukushima District Court rendered a conviction judgment against Toshio Tsumuraya, sentencing him to one year of imprisonment, suspended for three years.
